duagon AG, on behalf of itself and affiliated companies (collectively, “duagon”, “we”, “us”, “our”), has adopted the following Privacy Policy (the “Policy”) in furtherance of respecting online privacy and recognizing the need for appropriate protection and management of any personally identifiable information duagon may receive pertaining to visitors and users (“visitors”, “users”, “you”, “your”) of www.duagon.com or www.[example].duagon.com collectivly the “Website” and the need for advice about what duagon does with this information.

By visiting and using the Website visitors and users accept and consent to this Policy and the practices described therein and to duagon’s collecting, processing and using all personal information for the purposes stated therein.

The information collected and the purpose(s) for collection and processing of information

Duagon collects information when you register for an account, when you enter into transactions and when you visit or use the Website.

Information collected by us on or through the Website may include the following information: IP-address, user-ID, internet domain and host names, dates and times that our site is accessed, name of the file accessed, click patterns, operating system types and browser software, access status, data entered by user, transaction data. Such information may be (i) given by users and visitors; (ii) obtained automatically (see section “Automatic Information” below); (iii) obtained from cookies and comparable technologies; (iv) obtained from email communications, (v) and obtained from other sources, i.e. phonecalls. The purposes of collecting such information are marketing purposes as well as to help us to determine what is most beneficial for visitors and users, and how we can improve the services, features and content of the Website.

  1. Sometimes we may need such information as your name; e-mail address; profession and interests related thereto; employer. Such personal information duagon will use only to respond to inquiries, to process orders, for product registration, for marketing purposes or to allow you to access specific account information or documents and to administer your account, respectively. With regard to access of specific account information or documents you can either choose to give us the respective personal information or to not get access to this documents.

Duagon is not obliged to delete personal data after the use mentioned above but allowed to store your personal data.

If you tell us that you do not wish to have personal information used as a basis for further contact with you, we will respect your wishes. Users and visitors can choose to opt-out of receiving future e-mail or mailings by following the unsubscribe procedures generally provided with our communications. Your right to access information

duagon intends to maintain at all times accurate personal information. If for any reason the personal information you provided is required to be updated, corrected, changed or deleted, you may send updates and corrections, change and deletion requests to mail@duagon.com and we will incorporate the updates, corrections and changes as soon as practicable. Also, we will attempt to accommodate your request for deletion, provided, however, that we do not have any legal obligation to retain the record.

Please note that we may require verification of your identity and that we may withhold access to your information where we have the right to do so under applicable data protection legislation.

Where we can provide information access and correction, we will do so for free, except where it would require a disproportionate effort. 

 

How we deal with information from individuals under the age of 18

The Website does not seek to collect personal data from individuals under the age of 18. Individuals under the age of 18 should receive permission from their parent or legal guardian before providing any personal data to duagon on the Website. If we become aware that a minor under 18 has provided us with personal information without parental / guardian consent, we will delete such information form our files.

Processing Orders

The terms and conditions for the purchase of duagon products and duagon services have been specified in General Terms and Conditions Applicable to Products and Components of duagon AG (General Terms and Conditions Applicable to Products and Components of duagon AG). General Terms and Conditions Applicable to Products and Components of duagon AG are always published by duagon on its website. By accepting this Policy you hereby confirm to have taken notice of General Terms and Conditions Applicable to Products and Components of duagon AG and acceptance of them.

 

Copyrights

All rights to duagon products, in particular duagon intellectual property rights, are duagon rights, and duagon rights alone, and are not transferred.

You are not allowed to copy duagon products. In particular, the use of duagon software and firmware on other hardware is expressly prohibited.

Reverse engineering of duagon products and software pirating (use of the software and firmware on other products, copying or extracting the software or firmware, etc.) are also prohibited.

 

Samples of Duagon Products

You shall use samples provided by duagon without modification unless otherwise expressly authorized in writing by duagon. You agree that all samples provided by duagon shall remain solely within your control and shall not make samples or any portions thereof available to third parties without the prior written consent of duagon.

If you intend to transfer duagon products to a third party, you shall prior to this transfer promptly provide duagon with all information pertaining to the particular third party and the particular intended use of goods.

 

Changes to this Policy

This Policy may be amended from time to time without prior notification. If at any time duagon changes this Policy, duagon shall post an updated version of this Policy at www.duagon.com so users and visitors will know what information duagon gathers and how duagon can use this information.

 

Applicable law and jurisdiction

This Policy and all matters arising out of or in relation to this Policy shall be governed by, and construed in accordance with, the substantive laws of Switzerland, to the exclusion of any conflict of laws provisions and principles.

Any dispute, controversy or claim arising out of or in relation to this Policy shall be subject to the exclusive jurisdiction of the courts of CH-8953 Dietikon, Switzerland, and each user and visitor of the Website hereby irrevocably consents to the jurisdiction and venue of such courts.
